These Terms of Service ("Terms") govern your use of the website birchlyconsulting.com and the consulting services offered by Birchly Consulting ("Birchly," "we," "us," or "our"), a business based in New York, NY. By accessing our website or booking a consulting session, you agree to these Terms in full.
1. Services
Birchly Consulting provides business consulting and advisory services to Amazon sellers, including but not limited to strategy sessions, operational guidance, and growth consulting. All services are provided for informational and advisory purposes only.
Nothing in our services constitutes legal, financial, accounting, or tax advice. You are solely responsible for any business decisions you make based on information or recommendations provided during a consulting engagement.
2. Booking and Scheduling
Sessions are booked through our scheduling tool (Cal.com). By completing a booking, you agree to the session type, duration, and fee listed at the time of booking. Bookings are confirmed upon receipt of payment.
You are responsible for ensuring your contact and calendar information is accurate at the time of booking. We are not responsible for missed sessions resulting from incorrect information provided by you.
3. Fees and Payment
All fees for consulting services are displayed at the time of booking and are charged in U.S. dollars. Payments are processed securely through Stripe, Inc. By completing payment, you authorize the charge for the session amount displayed.
All sales are final unless otherwise stated. See Section 4 for our cancellation and rescheduling policy.
4. Cancellations and Rescheduling
- More than 1 calendar day before your session: You may reschedule or receive a full refund.
- Within 1 calendar day of your session: No refund is given for cancellation. Rescheduling is not available within this window.
- No-shows: Sessions where you do not attend and provide no prior notice are non-refundable and non-reschedulable.
To cancel or reschedule, use the link in your booking confirmation email or contact us at hello@birchlyconsulting.com.
Birchly Consulting reserves the right to cancel or reschedule a session with reasonable notice. In the event we cancel, you will receive a full refund or the option to reschedule at no additional cost.
5. Confidentiality
We treat all information you share during consulting sessions as confidential. We will not disclose your business details, financials, or strategies to third parties without your consent, except as required by law.
Likewise, any proprietary frameworks, tools, or methods we share during sessions are the intellectual property of Birchly Consulting and may not be reproduced or resold without written permission.
6. Limitation of Liability
To the fullest extent permitted by applicable law, Birchly Consulting shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services or website, including but not limited to lost profits, business losses, or data loss.
Our total liability to you for any claim arising from or related to our services shall not exceed the total amount you paid for the specific session giving rise to the claim.
7. Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee specific business outcomes, revenue results, or Amazon account performance from our consulting advice. Results depend on many factors outside our control including market conditions, your implementation, and Amazon's policies.
8. Intellectual Property
All content on birchlyconsulting.com — including text, graphics, logos, and frameworks — is the property of Birchly Consulting and protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.
9. Acceptable Use
You agree not to use our website or services to:
- Violate any applicable law or regulation
- Misrepresent your identity or business
- Interfere with the security or operation of our website
- Attempt to gain unauthorized access to any part of our systems
10. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in New York, NY.
